My company applied for GC for me in March 2002. The case filed in Massachustts. I got a query in MA SESA. Replied back to SESA.
Mean while shall I apply extension for H1B since it will expire in September 2003.
------ Your Employer can file for H1 Extension and you should file before the expiry date of current H1, VSC is taking around 5-6 months at present, If go for premium processing( paying extra $10000 it can be done in 15 days
My employer says it cannot be extended more than 2 times with the same company.
--- --Your Employer is WRONG; you can extend H1 more than 2 times. Ask him to speak to attorney (or employer may be having no job in future that may be the reason he is making stuff) in your situation if your LC is pending for 365 days and if you consumed 6 years on H1 then also your H1 can be extended for 7th year.
Request him to get new LCA form DOL it is Fax back system, employer or lawyer will get in a week time and ask him to file your H1 extension with I-129
