H1b extension

My H1B visa will expire nov 2012.. I'm planning to extend but before that im gonna go home 6mos before it expires to get married so that when i get back i'll start processing for that said extension.. so before i come back here in U.S., do i need to get a new passport and new visa stamp since my status has been changed? or can i still use my current passport and visa? Do i need to wait for my H1B extension to be approved before i can get my spouse? How to process the H4 visa for him and how long does it take? THANKS

------ Your H1 is expiring in 2012. your employer is ready to file H1 extension on time. You are going out of US for marriage. when you plan to go out of US? what date/month/2012 you will be back to US? Provide the full details so that you can get clear picture.

------- if one file H1 extension is NOT status change it is Status Extension. Extension can get approved or can denied. if one has Valid Visa stamp and Valid passport and got H1 extension approved why the person will need New Passport and Visa?

----- YES.if Extension approved and you have Valid H1 Visa stamp then no need of new Visa and at POE show the Visa in Passport AND H1 extension approval Notice
Do i need to wait for my H1B extension to be approved before i can get my spouse?
---- you have H1 Visa stamp till Nov 2012 and if you get married BEFORE Nov 2012 then your Spouse can apply for H4 visa from US Consulate.
How to process the H4 visa for him and how long does it take?
----- if spouse is out of US then spouse file the H4 through US Consulate. He/she need to pay the fees, marriage certificate and other papers from H1 holder and some documents from H1 Employer.

Hello,

I am new to these forums so i apologies if this is not the right thread for this sort of discussion. Here is the situation

Visa Valid till : April 3, 2013
I-94 Valid till: April 3, 2013

My employer is already starting the H1B Extension process using regular processing. Here are the questions i have:

1. In case visa extension is denied well before my I94 expires, can i stay in US till april 3, 2013? or do i have leave

country immediately upon denial of extension?
2. In case extension is denied, what are my options? provided i have time left in my I-94 expiry? Visa transfer? Repeal of

extension?

Any help would be appreciated.
