H1b Extension

Hi,

I was having my first employer H1b stamping on my Passport valid from 10/2004 to 9/2007. I moved to new employer on 11/2005 and got new H1b from 11/2005 to 11/2008.

I went to India on 12/2006 and returned on my previous employment stamping without getting stamping from india for new employment. While entering here in US, i just showed my passport which has previous employer stamping. I didn't showed my new employment approval notice. THey gave me new i-94 card which expires 9/2007 per previous employment stamping.

Now the issue is my laywer is telling that while applying for extension, I may have issues since my i-94 card has been expired while back. Please let me know,whats the solution for this. I have very few days to submit my extension application.

----------------------------At POE you were supposed to show Valid Visa stamp through previous employer in passport AND H1 approval notice of new employer and officer could have given you I-94 till your new employer H1 approval notice.

THey gave me new i-94 card which expires 9/2007 per previous employment stamping.

Now the issue is my laywer is telling that while applying for extension, I may have issues since my i-94 card has been expired while back.
