H1b extension

My H1b was approved for a year and valid till 30 June. I have to go back to India on May for 15 days. When should I apply for H1b extension? If I apply now w/o premium processing it won’t be approved by that time. Is it safe to come back and apply for H1b extension? I assume I can continue working even though my H1b extension petition is pending.

-----------yes as you will be back before 30th june. make sure that your H1 extension reach USCIS before 30 june. request the employer/lawyer to keep all the paperwork ready to file H1 EXT and once you are back give him the copy of latest I-94(front and back) that you will get when you enter US.

I assume I can continue working even though my H1b extension petition is pending.

Which option is better

Apply now for H1b extension and show the extension papers at port of entry or apply before 30 june after coming back from India?

1 you can apply H1 extension now (one can file H1 Ext 6 months advance of I-94 expiry date) if you get H1 extension approval BEFORE you come back to US and have valid visa stamp then you can show the Visa stamp AND H1 EXT approval at POE and you will get I-94 till H1 extension approval. Extension may take 3-5 months if you file through Premium process you can get it before you go out.

2 yo can file EXT when come back and Ext MUST reach USCIS BEFORE your I-94 expires
