Hi

I have filed my GC thrg company A in May-2003 from CA.My H1B expires in Oct 2005.My case has already moved from SESA to DOL last month.I expect to get it cleared by Oct -05.
I have been working for company B for last 2 years

My question

1)If I continue to work for Company B, is there a way I can obtain some document from the attorney , so that company B attorney can file extension for my H1B ?

2) Say I get my EAD sometime, can I immdtly start working for Company C, as I have GC filed thrg company A & they don't hold my H1 & I have never been thier employee.

I would appreiate some replies here.

1. It is called H1b transfer. All that you will need is your old H1b papers(all that you used) and copy of all passport pages, pay-stubs for 3 months(verify duration). You do not need anything from old company's lawyer.
2. That will be tough as AC-21 applies only if you have completed 180 days after filing 485 with your sponsor company.

Thanks for your immediate reply but I think you have misterpreted my questions.As mentioned in

1) In my first question, I have asked as what kinds document do I need from Company A ( who is filing my GC )attorney
( When I am working for Company B ) ??

2) In second question , as I am never employee of company A , how is it nessecary for me to wait for 180 days after filing my I-485.

1. Nothing. I guess you are going for another attorney. If yes then fill G-28 - hand it to your new attorney. If you want to be courteous - call your old attorney and let him know about it.

2. Then it is fine. But will your GC sponsor company defend your 140?
 
Defending I 140

Hi Jharkhandi

Yes the company I have filed thrg is owned by my very close friend.So He will defend my 140.In this process will the company have to bear some inquiries ?

I want to understand whether defending I 140 process is difficult for company ?

Yes if RFE is raised company has to defend it and respond to inquiries. Each RFE is different and also depends on case so any prediction - if it will be difficult - will be at the best speculation.
