My H1 6 year limit is in Oct 2004. I am employed by company A. Company A filed for my labor certification and it has been pending in CSC for over a year now. Can I file for 7th year extension with A and switch employer to B

My husband is on R1 visa and filed for GC thru his employer. His I360 petition is in processing.

My project would be over pretty soon and company A would stop paying me salary. Can I remain on H1 visa looking for jobs until he gets his EAD and then use EAD? Or do I need to convert my visa to R2?

----- Your employer can file 7th year H1 extension before your H1 or I-94 expires if you have LC pending more than 365 days and you or your lawyer who filed LC has to provide evidence to USCIS that your LC was filed 365 days back and the evidence of LC filing is receipt from SWA or SESA that they send after they receive LC that receipt has your name as beneficiary, case# and Receipt date on it

---- Company A can file 7th year H1 and company B can also file 7th year H1. If I am in your situation I will request A to file H1 extension and will stick to them till LC is not approved and once LC gets approved I would request A to file I-140, I-485, EAD, AP once I-140 gets approved I will be able to use AC21 and will think of changing employer
