H1B Extension - Suggetions Please

1. One of my friends first H1B visa term is over by 30-Sep-2003.
2. He applied for transfer through new company in Feb2003.
3. But he got the H1B as a new visa which says he needs to goto India for stamping.
4. Is there any way he can file I-129 again choosing the option
part 2-Column2-Selection C which is Change in previously approved employment.
5. By doing this will he be able to get the already approved new H1B corrected and get the I-94 so that he need not go to India for Stamping?

Please let me know if I am not clear or need some more information.

---- Do you mean he completed 6 years? Or has time but filed transfer with new company

----- he should go out of US, get new H1visa stamped and reenter US with new I-94

----- Did you mean the lawyer not filed as extension? If lawyer filed extension in same status and BCIS did not provide him new extended I-94 then he may have issues or lawyer filed for NEW H1 then he has to go out and get H1 visa. I don’t think you can do anything now. Talk to your lawyer if you file again for transfer you may not be having recent pay stubs from past company

---- talk to your lawyer as I don’t know the reason if he filed for new h1 or h1to h1 extension or messed up during filing or your friend
