H1B Extension RFE. I94 Expired. Also MBA Student. Worried

09/2007 - Entered US on F1. Did some language schools and courses.
10/01/2009 - Applied, Approved, Started working on H1B

I still work for the same company and applied for extension on 06/2012.

Today is October 11th, and my case just updated. They request for evidence. I haven't received the letter yet so I don't know what they're asking.

The catch is, my I-94 expired on October 1st, 10 days ago.

I will send whatever info they're asking.I work for a high-end electronics retailer as public relations specialist. No contract jobs or project.. It's a straight 9-5 job at the same address, I'm at work every single day. Have all my paystubs, W2s, you name it.

I also started MBA out of my pocket about 4 months ago, attending evening and weekend classes now.


My question is, If my extension gets denied (will probably be by the end of October, my I94 expired Oct 1st), what are my options?

Can I immediately go to my college that I'm currently attending, and ask for a change of status to F1?

Or Do I have to leave the country?

I don't need to apply for a new school, I'm already taking courses.

Everyone says different, some says I'll be out of status since Oct 1st and I have to do something within 30 days from I-94 expiration.

Some say I'll be out of status at the time of H1B denial, and then I have to leave immediately. Some also say, I still have 30 days to do something after H1B denial.

Totally confused.

I-94 expiring feb 2013 but H1 b still valid until oct 2014

hi, just want to ask what are my options to extend my I-94 since it will expire on feb 2013 but H1 b still valid until oct 2014. They only gave me until feb 2013 because my passport will expire at that time. Now I already have a new passport. I went to custom border and patrol to try to extend it but they turned me down. pls help!
