Dear Rajiv

My name is Rajiv Mehta. My h1b , visa stamping and I-94 expired on 30 Nov 2002. To this effect I applied for h1b extension.

I got notice of action for h1b and h4 for my wife and kids stating visa extention from 1 Dec 2002 to 30 Nov 2005.

There is a family emergency in India, which my wife must attend in the month of July.

If I understand right, I can either
mail my documents to Washington , DC for visa stamping., which evantually heading for 6-8 weeks processing
or
go back to India with my wife for processing, which my job does not permit.

Can you kindly suggest me the best possible way as to expedite the processing of my H1B, so as my wife can go to India and get her visa stamped there??
And later I can get visa stamped for my kids in normal fashion??

Your advise will definitely put me in some sort of decision making.

I appreciate you views.

Regards,
Rajiv Mehta

your wife can try for H4 (and your kids too) without your H1 stamping. H1 I797 approval might be required for them to get the H4 visa stamps. Find out from ttsvisas.com about the document requirements (including letter frm employer). H4 renewal should not take more than 3-4 weeks max at the US consulate.

You can get your visa revalidated later if you donot have any travel plans in the near future. You have upto a year of previous visa expiry date to complete revalidation. i.e till Nov 2003.
