H1B extension issue.

Hi,

I got my first visa in March 2002 and I worked in USA until Jan 2003. I went back to india after that and returned in Feb 2004 on same visa and 3 months later switched the job. Now my current employer is saying they can extend my visa only until march 2008 since I will be completing 6 years.

I was wondering if it is correct. Is it correct that if there is gap of( Do not work in US) more than one year between your two US visits you get 6 years after the date second time you arrive ?

If someone could please help, I will appreciate it.

Your current employer is correct. You can only recapture the time you are out side the USA. Since you are using the same visa you are not eligible to reset the h1 clock for new 6 yrs period.
