I am in India right now and my H1B expires in Aug 2007. I can not return to USA before the expiration due to personal reasons. I am also left with about 370 days to reach H1B 6 years period, which can be used to recapture. Also, I will complete 1 year of stay outside of USA in Jul 2007. Mean time, my employer has filed I140in Dec 2006 at Nebraska center.
Since I can't apply for an extension from India, what are all the options I have? Would I apply for new H1B which is not subject to the cap? When can I apply and how long would this take for processing?
