H1B extension based on I140 receipt

My H1b is expiring soon. I don't have my labor pending for more than a year. But I have applied for I140 and have the receipt. Can I extend my H1 based on I140 receipt. (I140 is not yet approved)

See if you can reclaim vacation time (time out of the country while on H1)
Do you have 485 pending? If yes, you can switch to EAD
I think you can file for H1 extension even now, but the date requested should be 365 days after I-140 application.
 
When did you file labor ?
You can't get H1 extension based on pending I140 unless you are exempt from labor and your I-140 was filed 365 days ago.
