H1b extension and LCA

Hi all,

Do I need to file LCA for H-1B1 extension (finishing my first 3 year H1B1 in December). Will be working for the same employer...

employer should get LCA and that should be sent with H1 extension.
 
Thank you Ginnu, Great Help.. I will ask my employer to file LCA. I have related question. If LCA is a must for H1-B extension, do employer again posts a 30-day advertisement or notice in work site and gets prevailing wage before filing LCA?

your company lawyer knows what to do before filing H1 ext.

I work for State Department, HR and legal experts in the department rarely or never deal with H1-B case. They are not aware of the procedure and hence was asked to find out the procedure. I filed H1-B new petition (prepared myself) back in 2006 with the help of my School's International Students' Office. Now that I am not with School and not familiar with extension procedure resorting to forum to find out answers to my doubts. Please let me know if you have any idea that job posting (same job, same employer, H1-B extension) needs to be done for H1-B extension. It will be a great help for me. what do you mean you work with State Department? do you mean Department of state???Times have changed it is not 2006.your employer should hire a good lawyer to file H1. At this time USCIS is sending RFE for many documents and USCIS is rejecting many H1 transfer or H1 extensions filed by consulting companies.

Thanks again. I work for Department of Health (not through consultant but directly hired by Department of Health). Since Health Departments' (most I guess) are non-profit governmental organization, department won't shell out money for attorney fees.. Hearing from what you said, seems it is good idea to hire attorney to avoid ugly situation. Looks like I should start shopping for attorney tomorrow and will observe the costs of hiring attorney.
