H1B extension and 7th year

Hi,

My H1 B expired on March 2003 in passport, but I have a valid
I-94 until Feb 20th 2004. Mean time I applied my 7th year extension in Sept of 2003. I'm still waiting for 7th year extension.


Is it ok to send my passport for revalidation to St.Louis after my 7th year extension approval? or will it be problem?.
I believe I need to get my visa revalidated with in a year of its expiry.

Pls advice as I'm very much concerned.

Note: I got my EAD/AP approved and my I-140 and I-485 is pending status.

To be safe side send your passport for revelidation. Yes

If your visa has expired, the Visa Office accepts applications for visa revalidation only if the visa is within one year of its expiration date.

your I-94 is abt. to expire in abt. a month. You applied for 7th yr. almost 3 months back.

I don't think does you any good to send in for revalidation to St.Louis, because:

1. What if you want to travel before I-94 expiration. You may be denying that option
2. You can't travel after I-94 expiration and before you get I-797 for 7th yr. So, what's the use of sending for revalidation.
3. Revalidation thru' St. Louis is taking longer. I have seen people request for withdrawl. So, even after you get 7th yr. extn. may be easier to travel outside and get it stamped (from a time period perspective)

Besides the H-1 issue, you mention you have EAD & AP. So, why on earth do you want to lock yourself out of any emergency/esssential travel to be done in short notice ???
