H1B expiring, Wife Pregnant

Hi,

My H1B is expiring in July. GC not processed. My wife is pregnant and in the second trimister. Is there any provision to extend the Visa? if the doctor says "No" to travel to India? I would like to extend the visa for 3 months.

Apply for h1 extension, in most cases INS gives an extension for a period you spent as vacation out side US.

---- you need the help of good lawyer. your lawyer may advice you to file for the recpture of days spent out of US or may file for COS to Visitor status and it needed to be filed BEFORE your and your spouse I-94 expires(doctors letter may help in this situation)
