I have 2 problems.
I had a COS from H4(5 years) to H1 this year and had gone for stamping to Vancouver.The visa officer wrongly wrote H4 on the I94 and also wrote the wrong date.How should this be rectified and how long does it take ? Can we use the I94 from the I-797 ( the approval notice instead ) if we need to use it for something ?
My H1-B is valid till June 17th 2007 ( Six years will be up).I have went to India for about 3 months in the last year and six months the year before.Can I claim this time that I spent away from USA to extend my visa by a year ? If I can,then how soon should I apply,how long does the processing take and what should I submit as evidence ?
Please advice.
