H1B Expires in 20 days - 485 filed a month ago.

Hi All -

My H1B expires in 20 days (July 25, 2007) and extension was filed in May 2007. My I-485 was filed in June.

I don't think my visa is going to get approved in time. Will I get out of status? What should I do?

Since your H-1B extension was filed before your original H-1 expired, you remain in status until it is adjudicated, and your work authorization is also active for up to 240 days after expiration.

Even if you didn't file the extension, your pending I-485 keeps you in status.

I am in a unique situation and seek your help.

My H1B extension for 8th year was filed in May. My company – A - got acquired by another company - B - last year. My paychecks as of today are from company – B.

In my H1B extension has the following.

- Seeking extension from same employer (presumably A)
- Tax ID is that of company B
- Name is that of company B
- Address is that of company B
- Total employees listed are those of company A
- Gross Income listed is that of company A
- Number of H1B employees are those of company A

My I-485 was filed in June of this year. My extension is still pending. Please advise me of the next steps. I am totally confused as what should be done now.

If all of A got bought by B, then yours is a situation known as a "successor in interest" and you should be fine. Did the attorneys have any issue with it?
 
Thanks RealCanadian for your reply. You are right. The company B bought A lock stock and barrel.

I have just notified the attorney but with time running out I sought help of the intelligent community that visits this forum.

I never knew the Federal Tax ID belonged to the acquiring company up until now. I would have thought that Tax ID should have been that the old company - A - if the employees numbers mentioned are those of A or vice versa.
