H1b expired in 2008 and converted to l1a- can i transfer l1a to h1b again

Hi,

I had H1B visa with companyA from 2005 through 2008 , I entered USA in 2007 May and stilll i am employed in USA for the same company. In 2008 Dec companyA converted H1B to L1A while i am in USA. Now i have I-94 valid till Dec 2011.

I have following questions.
A. If i want to move to companyB should i have to apply for new H1B or can i transfer the old H1B from companyA to company B , even if the old H1B expired in Dec 2008.

if the answer for above question is YES then i would like to know for how many years will i get the H1B visa for. My total years of stay until current date is 3 Years 9 Months.

--------------- At this time you are on L1 status and NOT on H1 status. Company B Can file Fresh H1 for you.

I have one more question to you now. If i apply for Fresh H1 will i have to wait for the H1-B cap or can i do it any time.

US employer can file H1 from April 1, 2011, nobody knows when the Cap will reach. You can work on H1 once H1 gets approved with H1 status I-94 attached. FYI I dont post for F1 or L1 better talk to your lawyer for your best options.
