H1B Expiration and Green Card Pending

Hi

I have filed for the AOS (1485) while my H1B is expiring on 30 sep 2009.
While my AOS and EAD are pending, will I be in legal status after 30 sep on the basis of my pending AOS application.

What effect it will have on I485 application, if my employer does not file for H-1 extension.

-------------------------how you will work if employer dont file H1 extension before 30 sep 2009? you dont have EAD in hand. request your employer to file H1 extension before your I-94 gets expired.
