H1B Expiration and Green Card filing

I have filed for the AOS (1485) while my H1B is expiring on 30 sep 2009.
While my AOS and EAD are pending, will I be in legal status after 30 sep on the basis of my pending AOS application.

What effect it will have on I485 application, if my employer does not file for H-1 extension.

Is your GC based on family sponsorship? The only drawback of not extending your H-1B is that you will not have any status to fall back on just in case your I-485 is denied.
