H1B Engineer: Min Prevailing Wages

Gurus,

Company is willing to sponsor me for an engineer position with a $40K annual salary.

Just talked to my lawyer that I will not qualify for the Required Min Wage for the engineer in CA.

What will be the min required wage for my position?

Will I continue to file this even I cannot met the min wage? What will be my chances?

Lawyer told me that its my choice, but it will be a difficult one.

I really need advice on this...

For a civil engineer in CA Level 1 $29 per hour Level 4 $ 41 per hour.

I am a mechanical engineer, but the position calls for pre engineering description. I believe that this will fall in the " Engineers, All others" category in the Min prevailing wages which for Level 1 is $25.05 - $52,104 per year.

My question is:
Is the $52,104 per year the total income with overtime? or w/o OT?
I can meet this $52,104 figure = $40K + overtime
 
As far as your W2 shows total income as 52K you are OK.

OT or no OT does not matter - only total in W2 counts. Prevailing wages differ with in a state , county to county
