You cannot transfer unless you are is status - which you are not at this time.
I had my H-1B extension COS denied and I had I-94 expired.Luckily they STILL approved my I-797 petition. I had to leave country to get visa stamped from India.To be honest, did not have any trouble getting it done from Consulate in India. I guesS you still have option to file MTR, but do it, if you have a very valid reason to believe that it will get approved, as that rarely happens.Honestly best bet is leave country and re-enter.

My husband got h1 transfer approved with new employer but extension of stay denied.Reason given by uscis was that he was out of status for 6 months.But during that time period he was working with previous employer, and have valid pay stubs.Previous employer is saying that he has not revoked it, neither he is giving any affidavit. new employer is saying that go to India immediately for visa stamping. Please advise as there is no fault of ours.
How we can defend ourself...my husband we never informed of visa revocation... also he was paid during that time period..
