H1B Cap

We have applied for a new H1B in Nov 2003 and have not heard back anything from INS.
I am wondering what is the state of H1B cap now?
Is the petiitons already filed come under this restriction? I mean whether my application considered under cap only when it is approved or when it is filed?

Is it worth going for premium processing now?

I greatly appreciate your suggestions..

Did you get the receipt number, that determines whether your application is under the cap or not. Converting to premium processing never hurts.
 
Yes I got the receipt number, but would that guarantee me that if nothing goes wrong with my application, I will be receiving my approval within the cap?

I dont understand the rationale behind INS/BCIS plan? They dont release how many H1B's have been issued so far... rumours floating around that they are already over 40K. I cant believe that.. On one side jobmarket is slowly picking up and in 3 months 13000 odd visas a month. If thats true they shoule be over by Feb end.
 
All we know for sure is that William R. Yates, Deputy Director, Citizenship and Immigration Services, stated that "(w)e are not near the cap at this time. As I stated last week we will release information at the end of January regarding where we stand and at that time will decide whether we need to notify customers of a projected "cap date." ... I still believe that we will hit the cap this spring, but I won't be more specific until I see the numbers in January."
