H1b cap

I have heard conflicting information regarding the effect of the H1b cap on waiver positions.

Does the H1b cap apply for waiver positions ??

If yes, was this a problem during the years when the H1bs capped ?

I was stuck in cap back in 1999 but since Y2K jwaivers are not subjected to cap specially if one is working in non for profit community health centers

even if J waiver is subjected to cap J applicants are consideded in status if H as I-94 for J has D/S stamped and one can convert status and start working right away once H is approved and doesnot have to get H stamped in order to start working
