I am in training on H1b, cap-exempt. Will be finishing end of June 2006 and want to join private practice. Now that job will be subject to cap. Current I-94 is valid until the end of 2006, though i won't be in this position until then. So if i file for H1b subject to cap in April 2006 with a start date of Oct 1st 2006 I will have 3 month gap in paychecks, but I guess by end of June I have got the approval; or maybe it doesn't work like that. Anyone has any thoughts/solutions for this situation.
And if it makes any difference I got my H1 after a hardship waiver of the J visa, hence the I-94 being valid longer than the duration of the training.
