H1B canceled.....URGENT

Hi,
Iam on H4. Though i got H1 approval in 2008, i never used it (never on H1). I went to my home country in 2010 and returned in jan 2011 after 8 months. I want to do job now. when i called my employer he said he canceled my H1 (without informing me). Can i ask my employer to return my H1 fees i paid for ($2500)? and can I file a complaint at DOL?. Iam concerned bec Iam on H4 all the time.

------ He will not return they money and you may be not having any proof that you paid to him. why did you pay for H1?
and can I file a complaint at DOL?
------DOL may also ask you why you paid him and you did not ask DOL before paying him for H1.
. I am concerned bec Iam on H4 all the time.
----------------- That is your choice. when employer filed H1 for you then you should have worked with him on H1 status after H1 was approved and you have not worked or the employer did not have job for you and employer revoked H1.

Try asking him but he/she will not pay back. If the person is Desi from Andhra Pardesh then forget it.
DOL will not help you and it is illegal to pay the money to get H1.DOL can recover your wages if you worked on H1 with employer and employer did not pay you.
I am 99.99% sure you cant get your money back.
