Hi,

I am on H1B VISA working with Client last 2 years. I am planning to Lease some Gas station. Can I start Company (S TYPE) and do lease with GAS Station. I know , I can not work in GAS Station.

1> Can I hire Citizen employee to Gas station
2> Can I take Profit ?

Any other risk and H1B to start Company.

you can be an inactive partner- so that it is considered an investment and profits can be considered passive income. You have to maintain your employment ...

No, that is not required by law. You can't derive any salary from Gas Station.
As Jaxen said, you need to maintain your full time employment to maintain H1B.

Yes you can, Citizen or Green Card holder.
2> Can I take Profit ?
Not directly in your name. Let the profit built up in the company name and can withdraw money in form of some expenses or in the payroll name of some other employee.
 
If the company owning the station is a corporation, you can be a shareholder and bet dividends just like if you purchased stock in Microsoft (or any other corporation). You can have NO part in managing the station and it seems that even interviewing a job applicant would be work.
