H1B bench vacation time

I want to transfer my H1b to company or COS to a grad school.

It has been 2 months that I have not gotten any pay stubs because my consulting firm did not have any project for me.

Is it possible that i can use that time by stating it was vacation time (unpaid) and get a letter from company rather than saying it was bench time which may annoying to CIS?

All I want is to leave that company without being out of status.

So in other words you are seeking advise on how best to commit immigration fraud?

If you are unpaid, you are out of status. Leave and re-enter the US in F1 status with a proper visa.
 
is it a fraud to have the vacations? people on h1bs can't have vacations? All I am saying is what is the limit on those vacations?
