Hi,
I have some questions regarding H1B visa.

Right now i am in US with L1 visa and working for a company A. When i applied for H1B for company B, i had a plan to goback to India in april, so i didn't apply for change of status instead applied for new H1B visa. Now my H1B petition got pickedup in lottery and i might get papers sometime around july-aug'08.

My questions are

1.When i receive H1B papers, does it mean H1B is approved and i can start working for comp B without stamping?.
2. When i receive papers, does it mean H1B is approved and L1 is cancelled?.
3. will L1 is valid until i do stamping.
4. is there any time limit to do stamping?.

I hope for answers..

Hi Raj:

As you have applied for a consular processing you cannot start woking in com B until you have an H1B I-94. Moreover, your H1B will start to be valid only from October 1, 2008, later which you may try to file a change of status request using form I-539, but you have pay the fees.

I would suggest to go get it stamped and come back.

I would like to know, in what cases the L1 will be invalid. Like
1. not stamping H1B or any other cases.
or
L1 will be valid till it expires even if i get H1B visa?.
 
Since your H-1B is quota subjected, this will have a start date of October 1, 2008. Now, as long as the I-94 corresponding to your L-1 is valid you can continue to work for employer A. In order to start with employer B October 1 is the earliest start date, also you need to get the H-1B stamped from a US consulate. Once you re-enter US on H-1B your L-1 will become invalid, and you are authorized to work for Employer B only.
