H1B approval

Hi,

My employment was terminated from company A on Sep 26, 2003. I applied for a H1B transfer of visa to company B on Nov 18, 2003. Initially when I applied I did have the severance pay and vacation pay stubs until Oct 13, 2003. INS issued an RFE to show pay stubs from Oct 14, 2003 till Nov 18, 2003. The only pay stub I have is dated Nov 28, 2003 with pay period from Nov 17-Nov 23 due to some payroll glitch from company A. Now, will INS approve my case???... Please reply..

Did you get paid from company A during Oct 14, 2003 till Nov 18, 2003? If yes and if you have misplaced the pay stub then you can request your company A to provide a duplicate which you can submit to USCIS/ INS and all should be fine in about 30 days from time of submission.

If you were out-of-status which means you stayed in usa without H-1B and without pay then you are in a bad situation. In this scenario, check with Rajiv Khanna or equally good lawyers and see if they can help you with this situation.
