Hi, Folks, I am currently under TN in the US and will apply for H1B on April 1st (H1B to start on October 1st if approved). My attorney said, if approved by USCIS in the mail, I would need to go to US consulate in Canada (I am a Canadian citizen) 10 days earlier than October 1st or after October 1st to get a visa stamp and re-enter as an H1B worker. Otherwise, I wouldn't be allowed to work under TN between the approval's receipt date (for example, August 1st or September 1st, etc.) and H1B's start date. Does anybody know if this is correct? I doubt it because I can hardly believe an approval of H1B to start on October 1st will "kill" my valid TN before that date.
