H1B application via status. Please help!

Hello, guys,

I am a new comer to this wonderful spot. My friends recommend this website to me.

Now I have a question. I have to change job by October 1, 2003. Currently, I am holding both H1B and EAD card (My I-140 have been approved, but I never use my EAD card, and my current H1B will be ended by September 30, 2003). My new employer would apply a premium H1B visa for me. To me, I just know premium H1B costs $1000.00 in additional to normal application fees. Because time is so tight for me, my question is: if I can not get my new H1B on time or my new H1B is denied, I will be out of legal status or I can still use my EAD to work?

Once you

apply for H1B you can start working for the new company, incase new h1B is rejected you should use your EAD
