H1B 7th Year extension

Hello,

Does USCIS/INS check the status of active pending GC labour case before approving H1b 7th year extension? ( OR ) the attorney/employer needs to attach some proof while applying 7th year extension itself..

In my case the GC labour was pending for more than two years and now Dallas BEC mistalenly closed the GC Labour case in error - Does it affect my 7th year H1b approval ?

It is you/your employer/your attorney's responsibility to prove that your LC is pending with EDD/DOL more than 365 days.
If you do not provide this evidence your 7th year extn will not be approved
