h1b 6th year extension, labor cleared within a year, I-140 not yet applied

can i get my H1-B 6th Year extension.
priority date or labor applied 11 months before i-94 expiration date. as i had been out of country for 2 months, i am thinking its still valid labor application for getting H1-b extension after 6th year. is this true?
i have not yet applied my I-140.my attorney said my labor will expire 1st quarter of 2008, so i am planning on applying I-140 in early 2008.now i need my H1-B extension to be applied, can i apply for 6th year H1b extension without applying I-140. i am confused because on the internet, its says I-140 should be pending for applying H1-Bextenstion. as i have not yet applied, is it OK to apply for 6th year H1b Extension with PD 11months before I-94 expiry date and apply for additional 2 months in this extension as i had been out of country. also how soon should i apply before my I-94 expiry date.

thanks very much for the reply

Did you get information. i am in same state as you. my lawyer says you can apply I 140 any time. there is no Labor Certi expiry date. how did you find that your LC is expiring.

I think you can applied your 7th yr H1B extension before filing your I140. I did it just a few months before and I am waiting for the result. As I know, we can apply the extension as long as our greencard process are pending for more than 365 days. I got my LC approved on July 2006(it took me more than 3 yrs. I am pending for the visa avalibiltiy now) and my 7th yr H1B has been expired on 1/2007. My visa is not current so I haven't applied for my I140 yet.
I will let you know when I got my extension approved.

I just checked online and my H1B the 8th yr extension is approved. That means you can apply your H1B extension before you submit your I140.
