H1 Vs H4

A friend of mine had an H1 visa stamped in India for the first time. But before she could come on project to USA her spouse got a project and got H1 visa stamped and she got H4 visa stamped and entered USA on H4.
Can she get an H1 transfer with another company based on the H1 that she has valid for another 3 years
 
Her first H1 is never activated by entering with H1 and obtained an I 94 card with 'Caveat' H1 on it.


Without a H1 - I 94 you can not transfer your old H1 to a new H1, however she can get new H1 and get her COS from H4 to H1 with out visa stamping.

This new H1 may come under Quota but h4 to H1 is same time possible.
