H1 Visa Revalidation

Hi,

I joined the new company 9 months back. I have my Ex-company's VISA on my passport. It expires on September 2003. I have the H1 B docs for my new company. I'm planning to go down to India in the beginning of next month. Do I need to get the stamping on my passport when I come back? Because I have seen the following in the URL (http://travel.state.gov/revals.html)

Revalidating Visas in the U.S:--

If your existing visa is still valid, it will not be considered for re-issuance until the remaining validity is within sixty days of expiring.

Do they revalidate the visa in India for me as my exisiting visa is valid until September 2003?.. Even if they revalidate can I come with my existing visa and show my new papers when I enter US?... Please assist me on this.

You can get the visa..

revalidation means only the process of getting a visa when you are inside the USA..so that 60 days stuff does not apply to you if you get a visa from India.

You could travel on the same old visa with new H1 papers but then the INS will muck up and get you a I-94 valid only upto the visa and not upto your approval notice...so to avoid all this nonsense got to India get a new visa ..since you already have a H1 visa..you can get one from the drop box..simple fast no questions asked.
 
I read a similar case this morning

Hi,

I was reading one of the threads this morning that someone got
an RFE for I-485 because he used the old company H1 while
coming back to US and got I-94 as (TT TT mentioned) based on
old Company H1. It looked like INS is asking about the H1 used
to enter (working for a different company etc.).
I got distracted this morning for some reason while reading that
post and didn't manage to read it completly. Look for all the
threads that have message RFE in the subject and you will find
it. If I find the thread I will come back and update this one.

Better to get the new H1 stamped.

when you enter US, you can show the new approval and get the I94 in the name of new company and expiry date (based on stamp in passport and new I797 approval). Make sure that you get this.
