H1 visa (Old Comapny in Passport) ; re-entry from India

Hi,
My friend has valid H1B visa stamping in the passport from Previous Company (Expires 2003).
Now with the new company, he got H1B papers, Is that okay to visit India and come back with the Old visa in the passport and showing new company\'s Papers to Immigration officer when entering back to USA.
( I guess it was not problem earlier, now I am not sure after sep.11).

If anybody has expeirences, Pl. share your opinion.

Using an old, but valid, H-1 stamp

According to my lawyer, it is okay for a person to travel using an old, but valid, H-1 stamp as long as the traveller has in his/her possession, the latest approval notice (I-797A, I believe), couple of the most recent paystubs and a letter from the employer, on the company letterhead, stating that he/she is employed from xxx to yyy (period of validity as given in the 797A) at a salary of $xxx.xx per year.

But, the above, by no means is an authoritative answer; neither is this move without any risks as all INS procedures are. If you have 3-4 months at your disposal before the travel, I would suggest that you get your visa revalidated through the State department.

Hi When you said previous visa is valid !!! Make sure your previous employee didn\'t revoke your pettition. Then you are fine.
 
Clarification Required

Hi,

I will be in a similar situation when I go to India in May. I have visa from old company (valid till 2003). I will be getting married and also bring my wife with me.

Can I apply for my wife H-4 visa using old company\'s visa, and can I return to US on old visa? Also, what happens if old company cancels the H1 petition? In a way it should not effect as visa is independent of petition (?)

Any info would be appreciated.

If your H1B is revoked then your visa automatically expires and you will need to file for the new visa on your new H1B.
