I am an F-1 student currently working on OPT as a contractor in a contract-to-hire position. I wish to apply for H1 for the year starting Oct 1, 2004. Due to a major reorganization in my company, my conversion to full-time (=H1B) has been delayed by a month or so. What would be the best gamble for me- get a visa sponsored by my contracting company & then transfer(they are asking for a 6 month commitment) or wait for another month & then apply as a full-time employee? Will the visas until then? Also, I will not be able to graduate until Fall04 because my professor is away visiting a foreign university. But I do have an BS degree & 2-yr work exp from India. Will this be a problem for H1?
