H1 visa - after 1 year outside US (6 years expired)

Hi All,

My 6 years for H1 visa expired early this year - and I got transferred to our office in canada in April 2003. I am interested in applying for H1 visa again (after 1 year), and have some questions about that:

* When can I apply for the H1 visa. Should I wait for 1 year before applying for visa, or can I apply for visa now for May 2004.

* What proof is required to show that I was out of country for 1 year. How does INS verify this ?

* Are there any risks that my visa will get rejected?

* Any other experiences is very welcome.

you can apply for H1 before 1yr expiry, just make sure that the start date of H1 is 1 yr from departure date.
Passport exit record. Other country entry record.
Why do you think your visa will be rejected?
