H1 validity, renenter US close(40 days) to expiry

Hi,

I have H1 validity till end Sep 2009, returned from US in May 09 after 2 yrs stay. Could you pls clarify foll questions on my reentry:

1) Can I enter US close to expiry date, say 40 days before expiry.
2) Can I file for extension from India or should I do it after entering US?
3) If i file ext from India can i show the same proof in POE.
4) How long does the H1 normal & P.P. extension approval take?

-----Yes you can if US employer has job and not wrote letter to cancel your H1 petition to USCIS.
2) Can I file for extension from India

or should I do it after entering US?
----------------employer can file once you are in US.

--------------normal about 3 months with PP 20-25 days from the date USCIS gets petition for extension
