H1 validity question

Hi Gurus,

I have an H1 validity question for you.

I was on H4 based on my husbands H1. In 2004, I got my own H1 but never used it. It expires in Sep, 2007. I was planning to work on a new H1 from this year, but looks like it's almost impossible to get a new one due to the quota issues.

- Can I use my old H1 to start working now (I have never used it or got stamped. Always used my H4 to enter the country).
- Is there a way to get my old H1 renewed now?

Did your H1 come with I 94 in 2004. If your ans is yes, then you are out of status by not working with the employer and not getting any pay stub.

Even if you want to go back to H4 pay stub is required to verify you are in status in H1.
