Guys,

I have mentioned 3 dates below as they appear on my H1 visa stamp, I797 and I-94. Upto which date can I travel in and out of USA without getting the new employer B visa stamped on my passport (just the approval notice of employer B)? Thanks in advance.

Visa stamp of employer A: Oct 2006 to Sept 2009
I-94: Aug 2007 to Oct 2009 (I entered USA in Aug 2007)
New I797 of employer B: Feb 2008 to Aug 2010 (No visa stamping done yet)

Cheers,
San

Your old visa stamp is valid till it expires (Sept 2009). This same stamp can be used with any employer who you have the I-797 for. So you can enter till the visa is valid.

Now, you can work in the U.S. till Aug 2010 and beyond assuming you will apply for extension. Your I-94 determines your status in the U.S. and you are good to stay till the I-94 expires even with an expired visa stamp.

In short,
Visa stamp is for entry only and can be used till it's valid for any employer.
You can stay in the U.S. till your I-94 expiration date.
