I am posting on behalf of a friend of mine, who is currently in India and in a state of confusion !
Here is the story.
Currently he is in India. The visa stamped in his passport is from a previous employer(A) which is valid until April 2004. He is no longer with that employer.
His present valid H1b is with a consultant(B). He has worked on the H1b for a client(C) of the consultant.
That project ended in december, but now the client(C) wants him to work full time with them. so the client(C) is going to process another H1B for this guy.
So now the question is should he even bother getting the consultant's(B) H1 stamped in the passport ? Can he come back on the old H1 of the previous company(A) ? Since that is valid till April 2004 ? However the previous company(A) actually is no longer there. Or is it best to get the passport stamped with the valid H1b(B).
The next question is if does get the new (consultant(B)) visa stamped, can he immediately apply for another H1b visa(with client (C)) as soon as he enters the country ?
Will that cause a problem ?
