H1 Transfer

Hello,

I would like to have your valuable advise in transfering H1. This is about my friend who is working for a reputed multi national company in India. Very often he is coming down to US on project and after completion he used to return back. At present he is being treated very badly by the onsite company manager and he is very much frustrated. Even though he works very hard the onsite company manager tries to discuss each n every issue of the project and sends out an email to the offshore by marking a bcc copy to my friend and this is making the situation too bad for my friend.

At this present scenario, what would be the best way to deal with the situation and the way to transfer his H1. My assumption if he resigns then the company might instruct the officials to cancel his H1 which will worsen his existence here and find out an alternative. I might be wrong.

If he is on valid H1 status working in US then he should find new employer who can file his H1 transfer petition with US. He will need his valid I-94, Copy of H1 approval and latest 2-3 Pay stub copy so that new employer/ lawyer can file his H1Transfer. If his H1 Transfer is filed BEFORE the present employer revoke his H1 Petition then he will be ok. Why to inform present employer that he filed H1 transfer through new employer? Once he gets H1 transfer filing receipt he can resign past employer and can join new employer.
