Is there a premium processing/standard option for H1 B transfer. If premium processing option is not selected how long does it take to receive the reciept and the transfer?

Similar Situation!!!

Hello!

I have the similar situation. I am applying for transfer of H-1 within a day or so. My wife and kids are going to India after a month. But am feeling that what if it delays the process? and my wife & kids's H4 does not come thru? Is there any premium processing for H4 TransfER? Also, my family's schedule is fixed after a month because of the a wedding in the family. What happens if I apply for H4 transfer for my family and it does not come thru before they leave for India?

I am currently on H-1B with a Californian Company and am transferring to a company in Texas. Please reply. Any help will be highly appreciated.

Hello!

I have the similar situation. I am applying for transfer of H-1 within a day or so.
My wife and kids are going to India after a month.

and my wife & kids's H4 does not come thru?
---------------- if they are having valid I-94 no need to apply H4 with your H1 Transfer. once they go out send them your H1 transfer approval they CAN enter US with valid H4 visa stamps(it does not matter if that H4 visa stamp has past employer name) and at POE they will show the valid H4 visa stamp AND your H1 transfer approval and will get I-94 till the validity of your H1 approval notice

-------- you dont need to apply H4 transfer. H4 is tied to your status it has nothing to do with employer A or B

Usually takes 1.5 -3 months I think (depends on how busy they are)

One Last Question!!!

Hi!! I had just one last question. If I apply for a transfer, and I leave for India before I get my H-1 Transferred, is it OK? Also, when I go for stamping in India, which H-1B Employer will be stamped on the Visa?

------------------- better go after you get H1 transfer approval or file H1 transfer after you come back. if file transfer H1 and you go out how you will enter US if H1 transfer is NOT approved and past employer informs USCIS to cancell H1 as you no more work with them???
