H1 transfer

Hi

case: Person is in US on H1 with one employer but currently not working on any client project (seating on bench). He gets an offer from another employer, and he does H1 transfer. Without informing to previous employer, he starts working on some client project with the new employer.

What would be the legal problems he eventually run into?

No problem from immigration point of view, but if previous employer had policy that does not allow thier employer to work for other company w/o resigning, it might trigger different type of trouble.
