I am trying to get my H1 transferred from Company A to company B.
The last paystub I have from company A is for the month of June and I applied for the transfer in Sept(providing May and June paystubs - the lawyer was dumb enough). I got a RFE for three recent paystubs. Now the application was received (by INS) by first week of Sept and I got the EAC number by mid Sept. I started working for the new proj assuming the portability of my H1. I was on bench for the month of Aug and half of Sept. My previous employer somehow ran my payroll for the month of July, which he says he gave it to me, and I believe it has been misplaced. So he has provided me with the payroll journal which shows the same details. I am still short of the Aug paystub and he is ready to give me a letter saying I was on an unpaid vacation for that duration. My concern is whether this will work for the transfer. He is not ready to backdate and run the payroll for me . Any response will be appreciated.
