Hello![]()
I'm transfering from Company A to Company B, I do not have the pysical 797 document, but my case status(online) says it is approved on June '26 07. Will I have any issues with this. Please advice.
Thx
If your H1 transfer was filed before your I-94 expired and with latest 2-3 pay stubs then H1 Transfer will be approved. For more info talk to lawyer who filed latest H1 transferHello,
My ex company filed for my 6 th year H1 extension and i have not got the physical copy of the approval notice yet. I lost my job with that company and now they are not ready to give any of my approval notices to me. They said that they will withdraw all of their filings.I have already filed for a transfer , but not including the previous approval notice. Instead i included the filing notice. My transfer has been filed on the day my termination with my ex- company came into effect.
In this scenario, what are the chances of my h1 being transferred sucessfully and am i at any kind of problem?
Please reply.
Thanks for the information. I-94 expired in May, but i continued my employment with Company A because at that time, my extensions was already filed by the, So, i had the most recent pay stubs when i filed for my H1 transfer with company B, except for that my I-94 expired. Is it still a problem?
Thanks in advance for your reply.
-------------it depends on USCIS if they check your I-94 in database then it will show that you have valid status at the time of filing H1 transfer filing, they can also ask for copy of I-94 (that is attached with H1 extension that was approved June 26,2006)Thanks a lot for helping me out. Here are the details.
I-94 expiry - May 15, 2007
H1 extension approved -- June 26 2007 [online status]
job terminated -- July 5 2007
New H1 sent -- July 5, 2007 ; [copy of filing is sent and not the approval]
----------------------H1 transfer is filed July 5, 2007 and your H1 was approved June 26 2007 (through previous employer) and that had I-94 attached (but you did not got it from employer) if you sent the copy of H1 extension filing that was filed by previous employer and if USCIS checks in system your I-94 validity then they may approve it, even if you sent online print of H1 extension approval USCIS can check that with reciept # why the new lawyer had not asked past company lawyer to give your I-94 or H1 approval? I dont know if new Employer wrote a cover letter and explained the situation
No chance of getting any documents from the previous employer. No details on the approval that is received.
-------------but you wrote that H1 extension was approved for past employer on june 26,2006
Do i stand a chance? Please let me know. Thanks.
Sincere thanks for the replies. I still have another question. What if by the time USCIS checks for the I-94 in their database, Company A has already revoked. Will that be a problem.
------------it can create problem IF your Transfer H1 filing reached USCIS later and employer revoked H1 petition before your H1 extension was filed. FYI USCIS take time to look at any latter that has no Fee attached with it and your past employer letter has not fee attached
Generally how long does it take to revoke, assuming that the Company A has withdrawn on 7/5/2007, does it come into effect immediately?
-------------- I think company letter may reach after your H1 Transfer was filed on 5th july
Will you please let me know.
Thanks a ton.
