H1 transfer situation

Hello All,

I am presently working for a company A and have received an offer from company B, i am on H1 since 2005 and want to change jobs.

They are ready to file for H1 transfer -

Questions:
1) I am aware that I can start work after the application is filed right ? Does that mean the day the application reaches the INS i can start work ?

2) What if the application gets rejected - I will lose both jobs ?

3) The job description for the 2 jobs are slightly different, both engineering related though - is that a big deal ?

4) Is it a good idea to change jobs before the application is approved ? Or should I wait.

Any help is appreciated.

Safest way is to wait till your application gets approved. Ask your new employer to file premium processing which comes in about 3 weeks. You have to pay $1000 extra for premium processing.

Work related to USCIS is not safe unless you get an actual approval. So if possible, file premium and wait till you get an approval. You can start working for new company as soon as you get receipt number.
 
Thanks for the heads up, but as it goes with everything its never easy ... they want me to start ASAP.

I am going to have to pursuade them to wait till I get approval. I guess that is the safest way to go.

Any idea how soon you get a receipt number after the application is filed.

My new employer did file for Premium processing under the Texas Center on Jun 13, anyone has idea on timelines ?

If I wait till the approval I will not have time to give notice to my present employer - I dont have anything in written from my present employer about notice.

Besides the un-professionalism of leaving a job without notice is there a legal impact?

Quitting my job after the receipt notice - its hard to comment but anyone has an idea if there have been any problems regarding that.

I have been in status and have the pay stubs and all the good stuff.

Just a little paranoid I guess !
