I used to work for a company A through June of 2004. When I changed my job, my new company B applied for an H1 transfer, which is still pending in RFE (8 months now). The USCIS needs some information from the company B, which it cannot furnish at the present time. In the meantime, my I-94 from the old company A has expired as of October 2004. I recently tried to get my H1 transfered to a new company C, but that petition has also returned an RFE citing that since my I-94 is no longer valid, they would have to wait until my visa with company B gets approved before they can make a decision. The likelihood of that happening is very bleak!
Given this scenario I would like to know what are my options now?
The company C is prepared to file for my H1 using consular processing. I was told that in that case I would have to go to India to get my visa stamped before I can work in the US again. Is this a workable solution? Given that my I-94 has expired, will I not have problems re-entering the US albeit with a new visa?
I would really appreciate some serious feedback on this case.
